{"id":28936,"date":"2024-03-05T00:02:40","date_gmt":"2024-03-05T00:02:40","guid":{"rendered":"https:\/\/lascrucestoday.com\/101gold\/earth-wind-fire-win-trademark-lawsuit-against-earth-wind-fire-cover-band\/"},"modified":"2024-03-05T00:02:40","modified_gmt":"2024-03-05T00:02:40","slug":"earth-wind-fire-win-trademark-lawsuit-against-earth-wind-fire-cover-band","status":"publish","type":"post","link":"https:\/\/lascrucestoday.com\/101gold\/earth-wind-fire-win-trademark-lawsuit-against-earth-wind-fire-cover-band\/","title":{"rendered":"Earth, Wind &amp; Fire win trademark lawsuit against Earth, Wind &amp; Fire cover band"},"content":{"rendered":"<div>\n<figure><img decoding=\"async\" src=\"https:\/\/s3.amazonaws.com\/syndication.abcaudio.com\/files\/2024-03-04\/Getty_EarthWind%26Fire_030424.jpg\" alt><figcaption>Steve Jennings\/Getty Images<\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\"><strong>Earth, Wind &amp; Fire<\/strong>\u00a0has won a lawsuit they brought against a cover band that they claimed was infringing on their trademark.<\/span>\u00a0<\/p>\n<p class=\"p1\"><span class=\"s1\">Back in March 2023, Earth, Wind &amp; Fire LLP, the rights holders of the Rock &amp; Roll Hall of Fame group&#8217;s trademark, sued Substantial Music Group and Stellar Communications over their\u00a0<strong>Earth, Wind &amp; Fire Legacy Reunion<\/strong>,\u00a0a tribute band featuring\u00a0unnamed \u201cformer members\u201d of the R&amp;B group.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The real Earth, Wind &amp; Fire argued Legacy Reunion was using the real band\u2019s logos, word mark and more to mislead consumers into paying more money for their shows.<\/span>\u00a0<\/p>\n<p class=\"p1\"><span class=\"s1\">In a ruling handed down Monday, March 4, in Miami, a judge\u00a0agreed with Earth, Wind &amp; Fire, ruling Legacy Reunion did indeed infringe on\u00a0their intellectual property rights, citing online posts by frustrated consumers\u00a0as proof the public was misled by Legacy Reunion\u2019s advertising.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">According to the ruling,\u00a0Legacy Reunion\u2019s \u201cadvertisements draw a close, unmistakable association with Earth, Wind &amp; Fire to a degree unwarranted by the historical record,\u201d noting that even if some members of Legacy Reunion were in Earth Wind &amp; Fire for a time, \u201cthe advertisement and marketing were still deceptive and misleading as to whether the main (or most prominently known) members of the band would be performing.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The judge ruled Legacy Reunion must now stop doing anything that will infringe on the Earth, Wind &amp; Fire trademarks. As for any monetary compensation, that will be decided during a bench trial in May.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In the meantime, the real Earth, Wind &amp; Fire\u00a0is set tour with <strong>Lionel Richie<\/strong> on the Sing A Song All Night Long tour, starting May 23 in Knoxville, Tennessee. They will also tour with <strong>Chicago<\/strong>\u00a0starting July 10 in St. Louis, Missouri.
