The battle over who owns the rights to The Guess Who<\/strong>‘s name and music has taken a sudden and extreme turn.<\/span>\u00a0<\/p>\n

The founding members of the band,\u00a0Burton Cummings\u00a0<\/strong>and\u00a0Randy Bachman<\/strong>, sued original members\u00a0Jim Kale\u00a0<\/strong>and\u00a0Garry Peterson <\/strong>in October, accusing them of misleading fans into thinking the founding members are part of the current lineup that’s on tour. Peterson is the only original member still touring with the group under the name The Guess Who.<\/span><\/p>\n

According to <\/span>Rolling Stone<\/strong><\/span><\/em><\/a>, in an effort to put an end to Kale and Peterson\u2019s version of The Guess Who, Cummings \u2014 who wrote the band\u2019s classic hits like \u201cAmerican Woman\u201d and \u201cThese Eyes\u201d and owns the publishing for them \u2014 has canceled the performing rights agreements for the songs. That means no band, including the current incarnation of The Guess Who,\u00a0is\u00a0allowed to play those songs live.<\/span><\/p>\n

Here’s how it works: By canceling those agreements, concert venues can no longer host any acts who are performing Cummings’ songs. If they do, Cummings\u2019 publishing company could sue them.\u00a0The move has already resulted in several The Guess Who concerts in Florida being canceled.<\/span><\/p>\n

But the\u00a0move will likely\u00a0wind up costing Cummings money, too, because it will prevent him from collecting royalties when the songs \u2014 or any covers of\u00a0those songs \u2014 are played on radio, TV shows and more.<\/span><\/p>\n

\u201cI\u2019m willing to do anything to stop the fake band; they\u2019re taking [Bachman and my] life story and pretending it\u2019s theirs,\u201d Cummings tells <\/span>Rolling Stone<\/span><\/em>. \u201cYes, I\u2019m going to lose some money, but we\u2019re going to find out what\u2019s worth what. I will not have this fake band going on any longer.”<\/span><\/p>\n

He adds, \u201cI\u2019m going to lose some money, but … the name is worthless without those songs.\u201d<\/p>\n
