Rodriguez\/Getty Images for J\/P HRO<\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\">A new lawsuit has been filed in Los Angeles accusing Warner Music of stealing footage for the 2021 <strong>Tom Petty<\/strong> documentary, <\/span><em><span class=\"s1\">Somewhere You Feel Free.<\/span><\/em><\/p>\n<p class=\"p1\"><span class=\"s1\">Filmmaker <strong>Martyn Atkins<\/strong> claims in his lawsuit he was hired in 1994 as art director for Petty\u2019s solo album <\/span><em><span class=\"s1\">Wildflowers<\/span><\/em><span class=\"s1\">, and would \u201con his own volition and at his own cost\u201d film Petty while making the album. He says he and the rocker would discuss possibly making a documentary from his footage, although it never happened due to Petty\u2019s 2017 death.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The suit says in 2020 he met with the Petty Estate and the rocker\u2019s daughter <strong>Adria Petty<\/strong> and they discussed a possible <\/span><em><span class=\"s1\">Wildflowers<\/span><\/em><span class=\"s1\"> documentary, with him as a producer and director. He claims they discussed the location of his footage, which he shared. The footage had been stored at Warner Records because in 2014 Petty offered to hold it for him \u201cfor safekeeping\u201d while Atkins was moving.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Atkins says after that initial meeting he never met with anyone again, and then in 2021 the documentary premiered with \u201ca shocking 45 minutes\u201d of the 90-minute film\u00a0made up of his footage, which he insists he\u2019s \u201cthe exclusive owner and author\u201d of. He says the doc also incorrectly claimed the footage was &#8220;discovered&#8221; when he always knew where it was.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThe Film\u2019s producers did not seek or obtain consent from Atkins to use his\u00a0copyrighted footage,\u201d reads the lawsuit, adding, &#8220;<\/span>Defendants not only stole and misappropriated the Works, but also deprived Atkins of the opportunity of creating (and thus becoming &#8216;the filmmaker who brought you&#8217;) the project Atkins largely filmed and which he had always envisioned.&#8221;<\/p>\n<p class=\"p1\"><span class=\"s2\">Atkins is suing Warner for copyright infringement, and is seeking actual and compensatory damages, as well as\u00a0an accounting of profits for the film and more.<\/span><\/p>\n<p class=\"p1\">\u00a0<\/p>\n<p>Copyright \u00a9 2024, ABC Audio.
