The battle between Joey Ramone<\/strong>\u2019s brother Mitchel Hyman<\/strong> (better known as Mickey Leigh<\/strong>) and Johnny Ramone<\/strong>\u2019s widow Linda Cummings-Ramone<\/strong> continues, with the latest court documents filed by Mickey.<\/span><\/p>\n

In documents filed in New York Friday, Mickey\u2019s lawyers\u00a0argue\u00a0Linda’s violating federal trademark law by using the Ramones name, since Johnny\u2019s real last name wasn\u2019t Ramone.<\/span><\/p>\n

The suit describes Linda as a \u201cformer Ramones groupie\u201d who \u201chas had an insatiable personal desire to shine a spotlight on herself,\u201d adding she\u2019s been \u201criding on the coattails of the Ramones.\u201d<\/span><\/p>\n

The suit calls out\u00a0her use of the Ramones name, especially since it wasn\u2019t any of the band members\u2019 real last names, noting, \u201c’Linda Ramone’ never existed while her husband, John Cummings<\/strong> (p\/k\/a Johnny Ramone) was alive.\u201d<\/span><\/p>\n

\u201cMs. Cummings-Ramone has made and continues to make blatant attempts to exploit and personally capitalize on and benefit from the name, goodwill and legacy of the Ramones \u2014 that is, to try to push the false narrative that she is the heiress to \u2026 the Ramones\u2019 legacy,\u201d the document reads. \u201cShe most certainly is not. She is nothing more than a blatant self-promoter and an infringer.\u201d<\/span><\/p>\n

Mickey is suing Linda for trademark infringement, trademark dilution and unfair competition.<\/span><\/p>\n

Linda was the first to file a lawsuit in the battle between the pair. In January, she sued Mickey over a variety of issues, including what she called an\u00a0\u201cunapproved and unauthorized Ramones-based biopic\u201d based on Mickey\u2019s memoir,\u00a0<\/span>I Slept with Joey Ramone,\u00a0<\/span><\/em>referring to Netflix\u2019s planned movie starring Pete Davidson\u00a0<\/strong>as Joey.<\/span><\/p>\n

Mickey responded by saying the claims were \u201cbaseless,\u201d since she had agreed to the movie in March 2006, adding it was \u201cnot a ‘Ramones biopic’ but rather one based on a family memoir.”<\/span><\/p>\n
